Terms of Service

Version 2026-05-03 · This document is binding once you accept it. We may update it; on a binding update we will require you to re-accept before continuing to use Aura.

Pre-launch draft. This is a substantive draft prepared by Aura's engineering team. It is intended for review by qualified counsel before public launch in any jurisdiction. By using a private beta or test deployment of Aura, you accept these terms as written here.

1. Who we are

Aura is a subscription platform for AI-generated adult content from synthetic creators. Aura is operated by the entity identified on our contact page (the "Company", "we", "us", "Aura"). These Terms govern your access to and use of the Aura website, application, APIs, and any related services (collectively, the "Service").

2. Eligibility

  1. You must be at least 18 years old to use the Service. If your jurisdiction sets a higher age (e.g., 21 in parts of the United States), you must meet that higher age. We may require identity-based age verification before allowing access to specific content or to creator features.
  2. You must be legally permitted to access adult content where you are located. You are responsible for compliance with local law. We may geo-block features or content in jurisdictions where access is unlawful or disfavored.
  3. You may not use the Service if you are subject to U.S. economic sanctions, are listed on a U.S. government denied-parties list, or are located in a jurisdiction subject to comprehensive U.S. embargoes.
  4. If you create an Aura account on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

3. Synthetic content commitment

  1. All content published on Aura must be generated entirely by artificial intelligence tools operated by the uploading creator. Photographs, video, or scans of real persons (even of the creator themselves) are prohibited unless explicitly permitted by Aura in writing for that creator.
  2. Every published asset is associated with an immutable consent record stating that (a) the asset is fully AI-generated, (b) it depicts no real identifiable person without that person's documented written consent, (c) it depicts no character that appears to be under 18, and (d) it does not use the likeness of any celebrity or public figure without documented written consent. Creators sign these records on every upload; we capture the signing IP address, user agent, and timestamp.
  3. Aura applies pre-publication automated content scanning (e.g., Thorn Safer, PhotoDNA, or equivalent) for known child sexual abuse material (CSAM) hashes and flags signatures. Posts that match are blocked, the account is suspended, and we report to NCMEC and equivalent authorities as required by 18 U.S.C. § 2258A and parallel laws.

4. Prohibited content (zero-tolerance)

The following are categorically prohibited. Any violation results in immediate, permanent termination of your account and (where applicable) reporting to law enforcement under PROTECT Act, art. 202 bis CPF (Mexico), the Take It Down Act (US, 2025), Ley Olimpia (Mexico), and parallel statutes.

  1. Sexual content depicting minors, in any form, including AI-generated content where the depicted character could reasonably be perceived as under 18. There is no "art" or "fiction" exception. Ambiguity is resolved against publication.
  2. Non-consensual intimate imagery, including AI deepfakes of real, identifiable persons created or uploaded without that person's documented written consent.
  3. Content depicting bestiality, necrophilia, or simulated rape, kidnapping, or torture presented as desirable.
  4. Content that solicits, depicts, or facilitates trafficking in persons.
  5. Content that promotes or facilitates illegal goods or services (controlled substances, weapons, etc.).
  6. Doxxing, stalking, harassment, or threats of violence against any person.

5. Restricted content (case-by-case review)

The following may be removed at our discretion. Patterns of these violations result in account termination.

  1. Content where the depicted character is not unambiguously an adult.
  2. Content resembling real celebrities or public figures, even if presented as transformative — unless accompanied by a creator-attested transformative-use claim that we accept.
  3. Public-figure satire that crosses into harassment or fabricated facts.
  4. Content that may infringe on third-party trademark or copyright.

6. Account security and use

  1. You are responsible for the security of your account credentials and connected wallet. We cannot recover funds sent from a wallet you no longer control.
  2. You may not (a) reverse-engineer or scrape the Service in violation of our Acceptable Use Policy, (b) impersonate any person or misrepresent affiliation, (c) use the Service to send unsolicited bulk messages, or (d) attempt to defeat our age verification, content moderation, or rate limiting controls.
  3. You may not create more than one account per natural person without our written permission. We may merge or terminate duplicate accounts at our discretion.

7. Payments

  1. Subscriptions, tips, and pay-per-view ("PPV") unlocks on Aura are paid in USDC on the Base network. Aura takes no custody of your funds. Payments settle directly to the creator's wallet, the platform treasury, and a content-safety fund through the AuraPayments smart contract, in the same transaction.
  2. Current platform fees: 13% of each payment to Aura, 2% to a content-safety fund, leaving 85% to the creator. The smart contract enforces a hard floor of 70% to the creator and a hard ceiling of 10% to the safety fund, so we cannot reduce your share below 70% without redeploying a new contract and migrating fans (which we would announce in advance).
  3. Crypto transactions are final. Aura does not process refunds and cannot reverse confirmed transactions on-chain. If a creator publishes an unlocked post that materially differs from what was advertised, file a complaint at /contact; we may issue platform-funded credit at our discretion.
  4. Payments are denominated in USDC. We do not provide currency conversion services. To convert USDC to fiat, you may use third-party exchanges; we provide informational guidance for Mexican creators at /cobrar.
  5. You are responsible for taxes on amounts you earn or spend on Aura. Aura may issue earnings statements on request and tax forms (1099 in the US, CFDIs in Mexico) where required by law.

8. Content licensing

  1. You retain all rights to content you upload (the "User Content"). You grant Aura a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, transmit, copy, modify (only for technical purposes such as transcoding, thumbnailing, watermarking, and accessibility), and distribute the User Content as necessary to operate and promote the Service.
  2. You grant fans who unlock or subscribe to your content a personal, non-transferable, non-exclusive license to view that content. Fans may not redistribute, scrape, or repost.
  3. You represent and warrant that you own or have the necessary rights to all User Content you upload and that no part of it infringes any third-party right.
  4. Upon termination of your account or removal of a post, the licenses above terminate, except (a) to the extent we must retain copies for legal record-keeping (consent records, payment records, takedown evidence), and (b) for content that has been distributed to fans through legitimate Service mechanisms (subscribers retain access through their period; unlocked content remains accessible to that fan unless removed for AUP violations).

9. DMCA and copyright

If you believe content on Aura infringes your copyright, file a notice as described in our DMCA Policy. We follow the safe-harbor procedure under 17 U.S.C. § 512. Repeat infringers are terminated.

10. Take It Down Act, Ley Olimpia, and similar removal rights

If content depicts you (or a person you represent) without that person's consent — even AI-generated — you may file a takedown request at /takedown without an Aura account and without proving copyright ownership. We respond within 24 hours. Repeated creator violations result in permanent ban and on-chain wallet denylist.

11. Termination

  1. You may close your account at any time from /settings. Account closure is a soft-delete: profile and posts are removed, but consent records, transaction history, and KYC records are retained for the legally required minimum (typically 7 years post-removal in the US for 2257-style records).
  2. We may suspend or terminate your account at any time for violation of these Terms, our AUP, applicable law, or abuse of the Service. We will notify you unless prohibited by law (e.g., a CSAM determination subject to NCMEC reporting).
  3. On termination for cause, you forfeit any pending platform credits or rebates. On-chain payments already settled remain settled (we have no custody to return).

12. Disclaimer of warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Aura disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation. We do not guarantee that on-chain transactions will succeed or that third-party providers (wallet vendors, RPC endpoints, payment processors, identity verifiers) will be available.

13. Limitation of liability

To the maximum extent permitted by law, Aura is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. Aura's aggregate liability for any claim arising from or relating to the Service is limited to the greater of (a) USD 100 or (b) the amount you paid Aura in fees during the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow these limitations; in that case the limitation applies to the maximum extent permitted.

14. Indemnification

You agree to indemnify, defend, and hold harmless Aura, its affiliates, and their respective officers, directors, employees, and agents from any claim, demand, damages, loss, liability, cost, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) User Content you uploaded, (c) your breach of these Terms, or (d) your violation of any law or third-party right.

15. Governing law and dispute resolution

  1. These Terms are governed by the laws of Mexico, without regard to conflict-of-laws principles.
  2. Any dispute arising from or relating to these Terms or the Service is subject to the exclusive jurisdiction of the courts of Mexico City, except that we may seek injunctive relief in any court of competent jurisdiction.
  3. If you are a consumer in a jurisdiction with mandatory consumer-protection laws (e.g., the EU, certain U.S. states), nothing in this section deprives you of the protections of those laws.
  4. You and Aura agree to attempt good-faith resolution before filing any claim, by contacting legal@aura.app with a description of the dispute. The 60-day informal-resolution window starts on receipt of that notice.

16. Changes

We may update these Terms. The current version is identified at the top of this page. For material changes (e.g., to liability, fee structure, or your content rights), we will require you to re-accept the new version before continuing to use the Service. For non-material changes (e.g., wording cleanups, contact updates), we may publish without re-acceptance.

17. Miscellaneous

  1. If any provision of these Terms is held unenforceable, the remainder remains in effect.
  2. Our failure to enforce a right is not a waiver of that right.
  3. You may not assign these Terms without our written consent. We may assign without your consent (e.g., in a merger or sale).
  4. These Terms, together with our Privacy Policy, AUP, DMCA Policy, 2257 Statement, and any creator-specific agreements, constitute the entire agreement between you and Aura.
