Creator Agreement

Pre-launch draft. This Agreement supplements our Terms of Service for users who publish content as creators. By applying to be a creator, you accept this Agreement in addition to the Terms.

1. Independent creator status

You are not an employee, agent, partner, or contractor of Aura. You operate as an independent third party who uses Aura as a publishing and payment platform. Nothing in this Agreement creates an employment, agency, partnership, or joint-venture relationship between you and Aura. You are responsible for your own taxes, business registrations, and compliance with local labor and tax law.

2. AI-only content

  1. You commit that 100% of content you upload is generated by AI tools you operate yourself, on your own hardware or via cloud services where you hold the account.
  2. You will not upload photographs, video, or scans of any real person — including yourself — claiming them as AI-generated.
  3. Mixed-media content (e.g., AI face on real-photo body) is treated as real-person content and is prohibited unless the depicted real person is you and you explicitly attest that fact in writing.
  4. You will disclose in each post the models and LoRAs used. We record this disclosure as part of your consent record.

3. No real persons without consent

  1. You will not generate, train on, or upload AI content modeled on identifiable real persons (celebrities, ex-partners, public figures, neighbors, etc.) without their documented written consent. "Documented" means a signed release that names you, the platform (Aura), the scope of use, and the depicted person; we may require you to produce it.
  2. Violation = immediate ban + civil and criminal liability under Take It Down Act (US, 2025), Ley Olimpia (Mexico), state-level revenge-porn statutes, and parallel laws in other jurisdictions.
  3. If a person whose likeness you used contacts you (directly or through Aura's takedown channel), you must cooperate with removal within 24 hours.

4. No minors

  1. You will not generate, upload, or facilitate any AI content depicting any character who appears to be under 18, even in fantasy, fictional, anime, or stylized contexts.
  2. Aura's posture is conservative: ambiguity is resolved against you. If our reviewers cannot quickly conclude that a character is unambiguously adult, the post is removed.
  3. Use of AI models trained on under-18 imagery is a violation independent of what you generate with them.
  4. Verified violation triggers immediate termination, mandatory reporting to NCMEC and equivalent authorities, and on-chain wallet denylist.

5. KYC and identity verification

  1. Before payouts, you must complete identity verification (KYC) via our designated provider (Yoti or equivalent). The provider validates your government ID and performs a liveness check.
  2. You must be at least 18 years old (or 21 where required) to operate a creator account. Some jurisdictions or content categories may require additional age verification.
  3. If your KYC is rejected, you may not collect payments. You may appeal at appeals@aura.app.
  4. We may re-verify your identity at any time (e.g., country change, three-year refresh, fraud signals).

6. Revenue split and payouts

  1. You receive 85% of every payment from your fans (subscriptions, tips, pay-per-view unlocks).
  2. Aura takes 13% as a platform fee.
  3. 2% goes to a content-safety fund used for moderation tooling, abuse prevention, and reporting infrastructure.
  4. Splits are enforced on-chain by the AuraPayments smart contract. The contract's creator share has a hardcoded floor of 70% and the safety fund a hardcoded ceiling of 10%, so Aura cannot reduce your share below 70% without redeploying a new contract and migrating fans (which we would announce in advance).
  5. Payouts arrive in your designated USDC wallet on Base the moment the fan's transaction mines on-chain. Aura has no custody of your funds, no rolling reserve, and no chargeback hold.

7. Tax obligations

  1. You are responsible for taxes on your earnings.
  2. For U.S. creators, Aura issues annual earnings statements and 1099 forms where required by IRS thresholds.
  3. For Mexican creators, you may need to issue CFDIs to your fans or to Aura. We provide earnings statements in formats compatible with SAT requirements.
  4. For other jurisdictions, we provide earnings statements on request. Consult your local tax advisor.
  5. Aura does not provide tax advice and is not responsible for your tax compliance.

8. Content moderation and removal

  1. We may remove your content if it violates our AUP, the Terms, or applicable law. We will notify you and explain the reason (except where prohibited, e.g., CSAM determinations subject to NCMEC reporting).
  2. We may apply strikes per the repeat-infringer policy: three verified strikes within 12 months result in permanent termination.
  3. Hard-prohibition violations (CSAM, non-consensual deepfakes) result in termination on first verified violation.
  4. You may appeal removals or strikes within 7 days at appeals@aura.app. Appeals are reviewed by a different moderator than the original decision.

9. Termination

  1. You may terminate your creator status at any time from /settings. On termination:
    • Your content is unpublished. Existing subscribers retain access through the end of their paid period unless we suspend for cause.
    • In-flight payments already on-chain remain settled (Aura has no custody to return).
    • Consent records, KYC records, and transaction history are retained for the legally required minimum.
  2. We may terminate your creator status for AUP violations, breach of this Agreement, or fraud. On termination for cause:
    • Your wallet may be denylisted across the platform (you cannot reclaim it under another account).
    • Pending platform credits or rebates are forfeited.

10. Indemnification

You indemnify, defend, and hold harmless Aura, its affiliates, and their respective officers, directors, employees, and agents from any claim, demand, damages, loss, liability, cost, or expense (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) content you uploaded; (c) your breach of this Agreement, the Terms, or the AUP; (d) any claim from a real person who alleges their likeness was used without consent; or (e) your violation of any law or third-party right.

11. Limitation of liability

Aura's aggregate liability to you for any claim arising from or relating to this Agreement is limited to the greater of (a) USD 100 or (b) the amount Aura collected as platform fees from your account during the 12 months preceding the event giving rise to the claim. Aura is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

12. Audits

We may, with reasonable notice, audit your records to verify compliance with this Agreement (e.g., consent documentation for likenesses, model provenance). Refusal to cooperate is grounds for termination.

13. Changes

We may update this Agreement. The current version is identified at the top of this page. Material changes (e.g., to revenue split, ban definitions, KYC requirements) require you to re-accept before continuing as a creator.

14. Governing law and dispute resolution

This Agreement is governed by the laws of Mexico. Disputes are subject to the exclusive jurisdiction of the courts of Mexico City, except where mandatory consumer-protection or labor laws of your jurisdiction apply.
